Welcome to Tinkerer's Workshop ("we", "our", or "us"). By downloading, installing, accessing, or playing our game (the "Game"), you agree to these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not download or use the Game.

 

1. Acceptance of Terms

 

By downloading or using the Game, you agree to comply with these Terms and all applicable laws. These Terms apply to all users of the Game. If you are using the Game on behalf of an organization or entity, you represent that you are authorized to accept these Terms on behalf of that entity.

 

2. License to Use

 

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Game, nor may you reverse engineer or attempt to extract the source code of the Game, unless laws prohibit those restrictions or you have our written permission.

 

3. User Conduct

 

You agree not to use the Game for any unlawful or prohibited activities, including but not limited to:

 

  • Violating any applicable laws or regulations

  • Exploiting bugs, cheating, or using unauthorized third-party software

  • Uploading or distributing harmful software, such as viruses or malware

  • Harassing, abusing, or harming other users

  • Impersonating any person or entity, or falsely stating your affiliation with a person or entity

  • Spamming or sending unauthorized commercial communications

 

We reserve the right to suspend or terminate your access to the Game if you engage in prohibited activities or violate these Terms.

 

4. In-App Purchases

 

The Game may offer virtual items, in-game currency, or other content for purchase ("In-App Purchases"). In-App Purchases can be made through the Apple App Store or Google Play Store. All sales are final, and no refunds will be provided except as required by applicable law.

 

You acknowledge that:

 

  • In-App Purchases are non-refundable and cannot be redeemed for cash.

  • Prices for In-App Purchases are subject to change.

  • Virtual items have no real-world monetary value and may be lost if your account is suspended or terminated.

 

5. Ownership and Intellectual Property

 

All content and materials in the Game, including but not limited to text, graphics, logos, images, audio, and software, are the intellectual property of Tinkerer’s Workshop or its licensors. You agree not to reproduce, distribute, display, or create derivative works from any part of the Game without prior written permission from us.

 

6. User-Generated Content

 

If the Game allows you to submit content, such as comments, reviews, or customizations (collectively "User Content"), you agree that:

 

  • You own or have the necessary rights to submit the User Content.

  • Your User Content will not infringe the rights of any third party, including intellectual property rights, privacy rights, or publicity rights.

  • We may use, modify, reproduce, and distribute your User Content as part of the Game without any compensation to you.

  • We reserve the right to remove or edit any User Content that violates these Terms or is otherwise inappropriate.

 

7. Limitation of Liability

 

To the maximum extent permitted by law, Word Voyager and its affiliates, directors, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the Game, even if we have been advised of the possibility of such damages.

 

8. Disclaimer of Warranties

 

The Game is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Game will be error-free, uninterrupted, or free of harmful components. You assume all risk for any damage to your device or data arising from your use of the Game.

 

9. Termination

 

We reserve the right to terminate or suspend your access to the Game at our sole discretion, without prior notice, for any reason, including but not limited to violation of these Terms. Upon termination, your license to use the Game will immediately cease, and any virtual items or in-game currency you have purchased may be forfeited.

 

10. Governing Law

 

These Terms and any disputes related to the Game will be governed by and construed in accordance with the laws of the Utah (USA) without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Utah, USA for the resolution of any disputes.

 

11. Changes to These Terms

 

We may update these Terms from time to time. When we do, we will post the revised Terms in the Game and update the "Last updated" date at the top of this page. Your continued use of the Game after any changes indicates your acceptance of the updated Terms.
